OVERVIEW
Welcome to Kviflon. Kviflon is a brand operated by RUUSAMA SUCCESS TRADING USA INC. The terms “Kviflon,” “we,” “us,” and “our” refer to RUUSAMA SUCCESS TRADING USA INC.
We operate this website and online store, including the information, content, features, tools, products, and related services made available through it (collectively, the “Services”). Our online store is hosted and powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when accessing or using the Services. Please read them carefully before using our website or placing an order.
By visiting, accessing, or using the Services, or by purchasing a product from us, you agree to be bound by these Terms of Service and acknowledge our Privacy Policy, Shipping Policy, and Return & Refund Policy.
If you do not agree to these Terms of Service, you should not access or use the Services.
SECTION 1 — ELIGIBILITY, ACCESS, AND ACCOUNTS
By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have permission from a parent or legal guardian to use the Services.
When browsing our store, creating an account, or placing an order, you may be asked to provide information including your name, email address, billing information, payment information, telephone number, and shipping address. You agree to provide information that is accurate, current, and complete.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without authorization.
You may not transfer, sell, assign, or license your customer account to another person without our written permission.
SECTION 2 — PRODUCT INFORMATION
We make reasonable efforts to display and describe our products accurately, including their specifications, dimensions, materials, colors, functions, included components, prices, and availability.
Product colors and appearance may vary slightly depending on lighting, photography, screen settings, and the device used to view the website. Minor differences that do not materially affect the product’s function may occur.
Product specifications and included components are stated on the applicable product page. Please review the product description, size, finish, electrical requirements, installation requirements, included accessories, and other specifications before placing an order.
Any product warranty is limited to the warranty expressly stated on the applicable product page or in the documentation supplied with that product. We do not represent that every product has the same warranty period.
We reserve the right to update product descriptions, discontinue products, or limit available quantities. Such changes will not affect products already purchased unless necessary to correct an error or comply with applicable law.
SECTION 3 — ORDERS, ACCEPTANCE, AND CANCELLATIONS
Submitting an order constitutes an offer to purchase the products listed in the order. Receipt of an automated order confirmation does not necessarily constitute final acceptance of the order.
An order is accepted when payment has been authorized and we confirm that the order has entered processing or fulfillment. We reserve the right to decline or cancel an order for legitimate reasons, including suspected fraud, unauthorized payment, incorrect pricing, inventory errors, shipping restrictions, or inability to verify information provided with the order.
If we cancel an order after payment has been collected, we will issue a full refund to the original payment method.
Please review your order carefully before submitting it. If you need to request a cancellation or change, contact us promptly at service@kviflon.com. We will make reasonable efforts to accommodate the request, but we cannot guarantee cancellation or modification after an order has entered warehouse processing, fulfillment, or shipment.
Returns and refunds after shipment are governed by our Return & Refund Policy.
SECTION 4 — PRICES, PROMOTIONS, PAYMENT, AND TAXES
Product prices are displayed in the currency selected for the applicable market. The product price, applicable discounts, shipping charges, taxes, and final order total will be displayed during checkout before you complete payment.
Eligible orders shipped to the United States receive free standard shipping. If an optional expedited or upgraded shipping service is available and selected, any applicable shipping charge will be displayed at checkout before payment.
Applicable sales taxes may be calculated and collected at checkout based on the shipping destination and applicable law.
Prices, discounts, and promotions may change without prior notice. However, price changes will not affect an order that has already been accepted and paid for, except where there is an obvious pricing or technical error. If an obvious pricing error affects an order, we will contact you and provide the option to confirm the order at the correct price or receive a full refund.
Promotional offers apply only to the products, variants, dates, quantities, and markets identified in the applicable promotion. Unless expressly stated otherwise, promotions cannot be combined. Any promotional conditions will be displayed before purchase.
You agree to provide current, complete, and accurate payment and billing information. You represent that you are authorized to use the payment method submitted with your order.
SECTION 5 — SHIPPING AND DELIVERY
Orders are generally processed within 1–2 business days, Monday through Friday, excluding weekends and holidays.
Estimated delivery times after processing are:
- United States: approximately 3–7 business days.
Delivery times are estimates and may be affected by weather, holidays, carrier disruptions, address problems, customs processing, or other circumstances outside our reasonable control. We will make reasonable efforts to notify customers of significant known delays.
Once an order ships, tracking information will be sent to the email address provided with the order. Customers are responsible for providing a complete and accurate shipping address and for monitoring available tracking information.
For certain high-value orders, we or the carrier may require a signature upon delivery.
If tracking indicates that a package was delivered but you cannot locate it, please contact us promptly. You may be required to cooperate with Kviflon and the carrier during a delivery investigation. We will review the circumstances and provide an appropriate resolution in accordance with applicable law and carrier investigation results.

SECTION 6 — RETURNS, REFUNDS, AND EXCHANGES
Eligible products may be returned within 60 days of delivery, subject to the conditions and procedures described in our Return & Refund Policy.
Customers must contact us before returning a product and obtain return authorization and return instructions. Products must not be returned to an address without authorization.
Return eligibility, return shipping responsibility, restocking fees, damaged or defective products, incorrect products, exchanges, and refund processing times are explained in our Return & Refund Policy.
If there is a conflict between this section and the Return & Refund Policy concerning a return or refund, the Return & Refund Policy will apply, except where applicable law provides greater rights to the customer.
SECTION 7 — INSTALLATION AND SAFE USE
Ceiling fans, lighting products, and other electrical products must be installed and used in accordance with the product instructions, applicable electrical codes, safety requirements, and product specifications.
Where required by law or reasonably necessary for safe installation, installation should be completed by a qualified or licensed electrician or other qualified professional.
You are responsible for confirming that the selected product is suitable for its intended location, ceiling type, electrical system, indoor or outdoor environment, voltage, and other installation conditions.
Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited.
SECTION 8 — INTELLECTUAL PROPERTY
The Services and their content—including our brand names, logos, text, graphics, photographs, product content, videos, audio, page designs, and software—are owned by or licensed to Kviflon and are protected by applicable intellectual property laws.
You may access and use the Services for personal, non-commercial shopping purposes. Unless expressly permitted by us in writing, you may not reproduce, distribute, modify, republish, publicly display, sell, license, or commercially exploit material from the Services.
Nothing in these Terms transfers ownership of our intellectual property or the intellectual property of our licensors to you.
SECTION 9 — OPTIONAL AND THIRD-PARTY TOOLS
We may provide access to tools, applications, payment services, review platforms, or other services operated by third parties. These third-party services may be governed by their own terms and privacy policies.
To the extent permitted by applicable law, we are not responsible for third-party tools or services that we do not own or control. You should review the applicable third-party terms before using them.

The Services may contain links to websites or resources operated by third parties. These links are provided for convenience and do not necessarily constitute our endorsement of the third party or its products or services.
We are not responsible for the content, security, availability, or practices of third-party websites that we do not control. Your use of third-party websites is subject to their applicable terms and policies.
SECTION 11 — RELATIONSHIP WITH SHOPIFY
Our online store is hosted by Shopify, which provides the ecommerce technology used to make the Services available.
Purchases made through our store are transactions directly between you and Kviflon, operated by RUUSAMA SUCCESS TRADING USA INC. Shopify is not the seller of the products offered through our store.
Shopify may process certain information as necessary to provide its platform services, as further explained in our Privacy Policy and Shopify’s applicable privacy documentation.
SECTION 12 — PRIVACY
Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy.
Because our store is hosted by Shopify, information may also be processed by Shopify and by service providers involved in payment processing, fraud prevention, order fulfillment, shipping, analytics, customer service, and other store operations.

SECTION 13 — FEEDBACK AND CUSTOMER REVIEWS
If you voluntarily submit a product review, photograph, video, suggestion, idea, or other feedback (“Feedback”), you represent that you have the right to submit it and that it does not infringe the rights of another person.
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, translate, display, and distribute the Feedback for purposes connected with operating, improving, and promoting our business and products, subject to applicable law and our Privacy Policy.
We may moderate or remove Feedback that is unlawful, abusive, fraudulent, misleading, unrelated to the applicable product, or otherwise violates these Terms. We do not require customers to submit only positive reviews.
SECTION 14 — ERRORS, INACCURACIES, AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, specifications, pricing, promotions, shipping charges, transit times, or availability.
We may correct such information and update the Services. If a material error affects an order you have placed, we will notify you using the contact information provided with the order and offer an appropriate resolution, which may include confirming the corrected order or canceling it for a full refund.
Nothing in this section limits any rights you may have under applicable consumer protection law.

You may use the Services only for lawful purposes. You may not use the Services:

Automated access must not circumvent security controls, access restricted areas, overload the Services, misrepresent the identity of the accessing system, or collect personal information unlawfully.
We may limit automated access where reasonably necessary to protect customers, website security, intellectual property, or the operation of the Services.
SECTION 17 — SUSPENSION AND TERMINATION
We may suspend or terminate access to the Services if we reasonably believe you have materially violated these Terms, engaged in fraud or unlawful conduct, threatened the security of the Services, or created a risk of harm to other users or our business.
Termination does not affect rights or obligations that arose before termination, including payment obligations for valid orders already placed.
SECTION 18 — WARRANTIES AND CONSUMER RIGHTS
We make reasonable efforts to provide the Services accurately and reliably. However, website access may occasionally be interrupted, delayed, or affected by maintenance, technical issues, or circumstances outside our reasonable control.
Except for warranties expressly stated on an applicable product page or supplied with a product, and to the extent permitted by applicable law, the Services are provided on an “as available” basis.
Nothing in these Terms excludes, restricts, or modifies any warranty, guarantee, condition, remedy, or consumer right that cannot legally be excluded, restricted, or modified under applicable law.
Any express product warranty stated on a product page or included with a product remains subject to its stated terms and is not excluded by this section.
SECTION 19 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Kviflon and RUUSAMA SUCCESS TRADING USA INC will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Services where such losses were not reasonably foreseeable.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where it cannot lawfully be limited, personal injury or death caused by negligence, breach of applicable consumer guarantees, or any other liability that cannot legally be excluded or limited.
Where liability may lawfully be limited, our aggregate liability relating to a product purchase will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires a different remedy or amount.
SECTION 20 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Kviflon, RUUSAMA SUCCESS TRADING USA INC, and their officers, employees, agents, contractors, licensors, and service providers from third-party claims arising directly from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person’s legal rights.
This section does not require a consumer to indemnify us for losses caused by our own negligence, breach of contract, unlawful conduct, or violation of applicable law.
SECTION 21 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary. The remaining provisions will continue in effect.
SECTION 22 — WAIVER AND ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms, together with the policies and notices incorporated by reference, constitute the agreement between you and us concerning your use of the Services and your purchases from our store.
If a product page or order confirmation provides a specific term concerning a product, promotion, delivery arrangement, or warranty, that specific term will apply to that product or order to the extent it does not conflict with applicable law.
SECTION 23 — ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign our rights and obligations as part of a merger, acquisition, reorganization, sale of assets, or other lawful business transfer, provided that doing so does not reduce any non-waivable consumer rights.

These Terms and any separate agreement through which we provide the Services are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles.
Subject to any mandatory rights or jurisdiction available to consumers under applicable law, disputes relating to these Terms or the Services will be brought in a court of competent jurisdiction located in Colorado, United States.
Nothing in this section deprives a consumer of protections or rights that cannot be waived under the laws applicable in the consumer’s place of residence.
SECTION 25 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices, policies, or legal obligations.
The current version will be posted on this page with an updated “Last updated” date. Changes will apply prospectively from the date they are posted unless applicable law requires otherwise.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms. Changes will not retroactively alter the material terms of an order already accepted and paid for, unless required by law or agreed with you.
